2.3 Device and System Requirements
You are solely responsible for the mobile device, network connectivity, and related communications costs required to use this Application. We do not guarantee that this Application will function properly in all device models, operating system versions, or network environments, nor are we responsible for any data loss, playback anomalies, or non-availability due to device compatibility issues.
3.1 User Content Ownership
All intellectual property rights and legal interests of the content you import, play, manage or rename through this App, such as video files, caption files, audio tracks, playlists, favorites and playback preferences (collectively referred to as “User Content”) are owned by you or your original legal rights holders. We do not claim any ownership of your User Content.
3.2 Content Processing License
In order to achieve core functions such as video decoding, subtitles loading, playback progress memory, playlist management, and more, you hereby grant us a limited license to process user content only locally on your device. We will not access, copy, store, or transmit your user content to our servers unless you actively upload the content to a remote server or share it externally in another way.
3.3 Applying Intellectual Property Rights
The App itself, including but not limited to the software code, interface designs, graphic images, trademarks, logos, decoder configurations, caption rendering engines, and related documentation, is the property of us or the relevant rights holders, and is protected by applicable Intellectual Property Law. It may not be used, copied, or disseminated without written permission by anyone.
3.4 Third-party Video and Subtitle Materials
You should ensure that any video clips, movie series, documentaries, subtitle files, external soundtracks, or other third-party materials that you import during the use of this application have received the legal authorization of the relevant rights holders. You are solely responsible for any rights disputes or legal liability arising from your use of third-party materials without authorization.
4.1 Legal Use Principles
You promise to strictly comply with the applicable laws and regulations of your jurisdiction, public procedure and good manners, and the terms of this Agreement when using this App, and not to use this App for any illegal, infringing rights or damaging the legitimate interests of others.

You may not use this App to do the following: (1) play, store, or distribute videos containing hate-provoking, discriminatory, violent, pornographic, or other illegal content; (2) play, distribute, or reproduce unauthorized pirated videos, copyrighted works, or infringing copyrighted copies; (3) infringe the copyrights, trademarks, patents, trade secrets, portrait rights, or other intellectual property rights of others; (4) produce, distribute, or use this App to process video material that can be used to deceive, defame, or harass others; (5) distribute spam, malicious software, or engage in any behavior that interferes with the proper operation of this Service; (6) impersonate others or mislead the public; and (7) engage in any activity that violates applicable laws or violates the rights of third parties.
4.3 Content Ownership
You are solely responsible for all User Content that you import, play back, manage, or distribute. We do not conduct prior checks on the legality, accuracy, completeness, or morality of User Content, but reserve the right to restrict functionality, refuse processing, or take any other necessary measures upon receipt of a valid notice or when we reasonably believe there is a violation.
5.1 Local Playback Tool Localization
PicoWatch is a purely local video playback tool that does not provide, index, or host any online video streaming, film and television assets, or third-party content. All video files that you play through this application come from your own device storage or from external storage media that you have legally obtained.
5.2 Format Compatibility and Decoding
This application is committed to supporting the widest possible range of video and audio formats (including MP4, MKV, AVI, MOV, FLV, and other containers, as well as common encodings), but subject to the device’s hardware decoding capabilities, encoding licenses, and technical limitations, we do not guarantee perfect playback of all formats, encodings, or special packaging. We are not responsible for playback failures, out-of-sync audio and graphics, or caption anomalies resulting from damaged files themselves, incompatible encodings, or insufficient device performance.
5.3 Subtitles and External Audio Tracks
This application supports loading external caption files and multitrack switching. You should ensure that the caption and audio track files you are loading have legal use rights. We make no warranties, express or implied, for translation accuracy, timeline alignment, or quality of audio track content in the caption files.
5.4 Local Storage of Playback Data
Play progress, play history, playlists, and favorites are all stored locally on your device. We are not responsible for any loss of local play data due to uninstallation, system cleanup, device failure, or misconduct. We recommend that you regularly back up your important playlist configuration.
6.1 Third-party integrations
This Application may integrate or access technology components, open source libraries, crash reporting services, or performance analysis tools provided by third parties. Such third-party services operate under their respective privacy policies and service terms, and we do not control and are not responsible for the content, privacy practices, or availability of third-party services.
6.2 External Links and Content
This Application may contain links to third-party websites, products or services. These links are intended only for your convenience, and we do not review or endorse the content, accuracy, legality or availability of any third-party websites. Your access to third-party websites is at your own risk.
6.3 App Stores and Distribution Channels
When you download this App through a third-party App Store, the terms of use, payment rules, and refund policies of that store are independent of this agreement. We are not responsible for App Store review results, download speed, or payment security. When involving subscriptions or in-app purchases, the relevant transaction rules are governed by the App Store terms.
7.1 Provided “As It Is”
This App is provided as “as is” and “AS AVAILABLE.” To the fullest extent permitted by applicable law, we do not make any express or implied statements and warranties regarding the non-interruption, error-free, safe, reliable, or fully conforming to your expectations of this Service, including but not limited to implied warranties of marketability, suitability for a specific purpose, and non-violation.
7.2 Data Loss Risk
You should do your own external backup of important video files, subtitles, playlist configuration, and playback progress. We are not responsible for any loss of user content due to device failure, misoperation, application crash, uninstall, system upgrades, or other causes.
7.3 Service Changes and Interrupts
We reserve the right to modify, suspend, or terminate all or part of the functionality of this Service at any time, without notice. We are not responsible for any losses caused by modification, suspension, termination, or data storage capacity limitations of the Service.
7.4 Networks and Third-Party Dependencies
Some functionality of this application (such as crash reporting, version checking) may depend on network connectivity or third-party services. We are not responsible for functionality limitations due to network disruption, the non-availability of third-party services, or carrier restrictions.
8.1 Maximum liability
To the maximum extent permitted by applicable law, we and our affiliates, directors, employees, and licensors will not be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits, data loss, business disruption) resulting from your use or inability to use this Service, even if we have been informed of the possibility of such damages.
8.2 Exceptions
The limitations of liability in this Agreement do not apply to: (1) personal harm caused by our intentional or serious negligence; and (2) other situations where limitations of liability are not permitted by applicable law.
8.3 Your Compensation Obligations
If any third party makes a claim, demand, or lawsuit against us (including reasonable lawyer fees) due to your violation of this agreement, violation of third party rights, or violation of applicable law, you agree to defend, indemnify, and exonerate them from all resulting losses and liability.
8.4 Notice of infringement
If you believe that content imported or used by users in this App violates your intellectual property rights, you can send us a written infringement notice through the contact email specified in this agreement, and we will process it as required by applicable law upon receipt of the valid notice.
9.1 Applicable law and dispute resolution
The effectiveness, interpretation, and dispute resolution of this Agreement are governed by international business practices and the laws of applicable jurisdictions. Any dispute arising from this Agreement should first be resolved through friendly negotiation; if negotiation fails, any party may seek relief from a jurisdiction.
9.2 Divisibility
If any provision of this Agreement is deemed invalid, illegal or unenforceable by any jurisdiction, that provision shall be enforced to the maximum permitted extent, without affecting the validity of the rest of the provisions of this Agreement, and the parties shall replace the invalid provision with a valid provision that most closely approximates the intention of the original provision.
9.3 Complete Agreement
This Agreement, together with the Privacy Policy and other supplementary terms published in this Application, constitutes the complete agreement between you and us regarding the use of these Services, and supersedes all previous verbal or written agreements reached by both parties regarding the same matter.
9.4 Not exercising a right does not constitute a waiver
Our failure or delay in exercising any of the rights under this Agreement does not constitute a waiver of that right; any individual or partial exercising of that right does not exclude further exercising of that right or any other right.
10.1 Conditions Amendment
We reserve the right to amend this Agreement at any time. The amended Agreement will be published in this App or through official channels, and will take effect from the date of publication. If you do not agree to the amendments, you should immediately stop using this App; your continued use of this Service after the amendment of the Agreement will be considered as accepting all the amended terms.
10.2 Termination of the Agreement
You can terminate this Agreement at any time by uninstalling this App. If you seriously violate any of the terms of this Agreement, we reserve the right to immediately terminate the granting of your license, and reserve the right to pursue appropriate legal liability. Upon termination of this Agreement, you should stop using this App and destroy all copies.
10.3 Effectiveness After Termination
The provisions of this Agreement regarding intellectual property rights, disclaimers, limitations of liability, compensation obligations, and applicable laws remain in force after the end of the Agreement.
